§ 8.08.050. Contract-Collection-Exclusive.

  • A.

    At such time as there is in force a contract entered into by the city with any contractor for the collection of solid waste in the city, it is unlawful for any person, other than the persons in the employ of the contractor having such contract, to collect or transport any solid waste within the city except as provided in this chapter.

    B.

    Notwithstanding the above, the contractor shall not have the exclusive right to collect and dispose of the following types of materials:

    1.

    Garden trimmings, when removed by gardening service;

    2.

    Rubbish or refuse:

    a.

    Accumulated as the result of a new construction, structure demolition or modification when the building/demolition/modification contractor operates the equipment necessary to remove the demolished rubbish or refuse;

    b.

    Which must be removed only as incident to the infrequent clearing of a premise.
